Which Courthouse Handles a Foreclosure in Calgary?

Foreclosures in Alberta are heard in the Court of King's Bench — a lender cannot sell your home without going through the court. For Calgary homeowners, that means the Calgary Courts Centre at 601 5 St SW.

Where your title work goes

Separately from the court, anything registered against your property runs through Alberta Land Titles. For Calgary, that is Land Titles South, also in Calgary.

This is worth getting right, because Land Titles has been slow since the counters closed to walk-ins in September 2025, with registration turnarounds reported in the region of a hundred days. That backlog is part of every timeline now, and it is a reason to start earlier than feels necessary.

Free help for Calgary homeowners

Calgary Legal Guidance runs free evening clinics Monday to Thursday (403-234-9266). The Court Assistance Program offers free 30-minute volunteer-lawyer consults for self-represented civil litigants, walk-in, at the Courts Centre. The Basic Needs Fund, reached through 211, provides emergency money for rent arrears and eviction prevention.

What actually happens at court

Less than people fear. Much of a foreclosure is documents rather than dramatic hearings, and an undefended claim moves through its stages without you ever standing up in a courtroom. That is also the risk: the process advances whether or not you engage with it, so engaging is how you keep a say in the outcome.

Calgary has done this before. In 2013 the flood put 75,000 people out of their homes, and what came out of it was Neighbour Day, which the city still marks every June. Needing help through a hard stretch is not a Calgary character flaw. It is closer to a Calgary tradition.

Do I have to attend court in Calgary?

Often not. Much of the process runs on documents, and an undefended matter can proceed without you appearing. If you intend to defend, or to ask the court for more time, that changes — and it is a conversation to have with a lawyer.

Can I see the documents filed about my property?

You are a party to the action, so you are entitled to the documents served on you. If you never received them or have lost them, say so to a lawyer or the clinic you speak to. It is a normal request.

Is a local courthouse the same as the Court of King's Bench?

Not always. Some communities have an Alberta Court of Justice location that does not hear foreclosures. Foreclosure filings go to the King's Bench judicial centre for the area.
